What is Felony DUI?

Washington’s Felony DUI Law was created in 2007 with an amendment to the Revised Code of Washington.  Now, an individual can face being charged with Felony DUI if either (a) this is their fifth DUI (or similar charge or a charge reduced from DUI to a lesser offense) in 10 years, or if (b) in the person’s lifetime they have ever been convicted of a vehicular homicide or vehicular assault with alcohol or drugs involved.  See RCW 46.61
