Attorneys Brian Sullivan, Melissa Sullivan, and Jason Lantz with the Sullivan Law Group, PLLC, have been leading a group of attorneys representing dozens of clients in litigation challenging the Draeger Alcotest 9510 in Snohomish County DUI cases.  The Draeger is the Washington State Patrol’s new breath testing machine.  Through extensive litigation and court hearings, Sullivan Law Group attorneys have identified serious flaws in the Draeger software.

 

Sullivan Law Group attorneys discovered that the Draeger actually uses software to increase the reported breath test result.  The Draeger, including DUI cases in Snohomish County, uses a fuel cell to measure breath alcohol concentration.  As the fuel cell ages, it starts to report lowers BAC results.  In order to save money, the Washington State Patrol programmed the Draeger to increase the BAC result to account for the aging of the fuel cell.  Sullivan Law Group attorneys will use this issue in litigation and believe that juries will hold the state accountable for using software to increase BAC results in DUI cases.
